Supreme Court to decide fate of Vaccine Court

The Supreme Court is set to decide whether the Vaccine Court (called the Vaccine Injury Compensation Program or VICP) will remain the first place people must go to receive compensation for vaccine related injuries.

Congress created the VICP in 1986 to protect drug companies from lawsuits for vaccine related injuries. The program is funded through a special tax on all sales of vaccines.  The Supreme Court’s decision hinges on whether or not the VICP covers vaccine injuries that could be avoided by better design of either of the drug itself or its warning label.
