Gardasil: A Widely Administered Vaccine With a Complex Legal History
Gardasil is a vaccine developed by Merck & Co. to protect against certain strains of the human papillomavirus, which can cause cervical cancer and other HPV-related conditions. The original Gardasil vaccine received FDA approval in 2006, and the updated Gardasil 9 followed in 2014.
The vaccine is routinely administered to adolescents and young adults, typically in a series of doses, and is one of the most widely distributed children’s vaccines in the United States.
Since its introduction, Gardasil has also become one of the most litigated vaccines in the country. Reports of serious adverse events, including autoimmune conditions, neurological disorders, reproductive complications, and, in some cases, death, have led to more than 1,000 HPV vaccine petitions under the VICP. Eventually, a major federal multidistrict litigation was held in the Western District of North Carolina. The federal Gardasil MDL encountered two significant developments in 2025. In March, the district court granted Merck summary judgment on the remaining failure-to-warn claims in the bellwether cases, concluding that federal law did not permit Merck to add the proposed POTS and POI warnings unilaterally based on the evidence available at the relevant times. In a separate September 2025 decision involving three other claimants, the Fourth Circuit held that timely compliance with the VICP process is a prerequisite to pursuing covered civil claims and upheld Gardasil’s inclusion under the Vaccine Act.

Filing an HPV Vaccine (Gardasil) Injury Claim: The VICP and the Current Litigation Landscape
Gardasil is a covered vaccine under the National Vaccine Injury Compensation Program, even though many of the injuries associated with it do not appear on the Vaccine Injury Table. Under federal law, individuals who believe they were injured by a covered vaccine are generally required to file a VICP claim petition before pursuing civil litigation against the manufacturer.
